Acceptable Use Policy

1. Introduction
This Acceptable Use Policy ("Policy") outlines the rules and expectations for using the Aserta Shopify application. By installing and using Aserta, you agree to comply with this Policy. Violations may result in suspension or termination of your account.
2. Permitted Uses
You are permitted to use Aserta to:
- Perform automated compliance audits on your product ingredient lists
- Format product descriptions in accordance with regional regulatory frameworks
- Generate compliance reports for your own record-keeping and regulatory submissions
- Store compliance metadata in Shopify metafields for your store
- Access the Aserta dashboard to manage your audit settings and subscriptions
- Request support from Aserta for technical issues or feature questions
3. Prohibited Uses
3.1 Illegal or Fraudulent Activity
- Use Aserta for any unlawful, illegal, or fraudulent purpose
- Use Aserta to circumvent or violate any law or regulation
- Use Aserta to facilitate money laundering, fraud, or financial crimes
- Use Aserta to support or promote illegal goods or services
3.2 Harassment, Abuse, and Threats
- Use Aserta to harass, defame, intimidate, or threaten any person or organization
- Use Aserta to engage in cyberbullying or targeted abuse
- Use Aserta to publish or transmit hate speech or discriminatory content
- Use Aserta to communicate threats of violence or harm
3.3 Intellectual Property Infringement
- Use Aserta to infringe patents, copyrights, trademarks, or trade secrets
- Use Aserta to distribute counterfeit or pirated content
- Upload product descriptions containing content that violates third-party IP rights
- Use Aserta in a manner that steals intellectual property from other merchants
3.4 Technical Abuse and Hacking
- Attempt to reverse engineer, decompile, disassemble, or hack the Aserta application
- Attempt to gain unauthorized access to Aserta systems, databases, or servers
- Attempt to access other merchants' data without authorization
- Transmit viruses, malware, worms, or other harmful code to Aserta systems
- Use automated scraping tools or bots to extract data from Aserta without permission
- Conduct denial-of-service (DoS) attacks or similar attacks on Aserta infrastructure
- Exploit security vulnerabilities or bugs without responsible disclosure
Example: You discover a security vulnerability in the Aserta app. Instead of attempting to exploit it, you contact us at security@getaserta.com with details. We appreciate responsible disclosure and may offer a reward for critical vulnerabilities.
3.5 Data Misuse and Privacy Violations
- Collect or extract other merchants' product data or customer information
- Use Aserta to create datasets of competitors' products for resale or redistribution
- Attempt to identify or profile individual customers using Aserta
- Use Aserta to process personal data for purposes other than compliance auditing
- Violate GDPR, Data Protection Act 2018, or other privacy laws
3.6 Interference with Service Integrity
- Disrupt the normal operation of Aserta systems or networks
- Attempt to gain unauthorized administrative access
- Interfere with Shopify API integrations or webhook delivery
- Use Aserta in a manner that impairs service quality for other users
- Conduct load testing or stress testing without explicit written permission
3.7 Content Violations
- Use Aserta to host, distribute, or transmit adult/sexually explicit content
- Use Aserta to promote gambling, illegal substances, or weapons
- Use Aserta to distribute false or misleading health claims (beyond compliance auditing)
- Use Aserta to distribute spam, phishing emails, or unsolicited messages
3.8 Commercial Misuse
- Resell Aserta services without authorization
- Use Aserta as a software-as-a-service (SaaS) platform for other merchants
- Use Aserta to generate datasets for competitive advantage or resale
- Use Aserta for purposes not related to your own compliance auditing
Example: You are a freelance consultant who wants to use Aserta to audit products for multiple clients. This is prohibited unless each client purchases their own Aserta subscription. You cannot use a single subscription to service multiple merchants.
4. Account Responsibility
4.1 Account Security
You are responsible for maintaining the confidentiality of your Shopify login credentials and API tokens. Aserta is not liable for unauthorized access resulting from your failure to protect your credentials.
4.2 Accurate Information
You agree to provide accurate, truthful information when registering your Shopify store with Aserta. Providing false information is prohibited.
4.3 Product Data Accuracy
You are solely responsible for the accuracy and legality of product data in your Shopify store. Aserta audits this data but does not verify its accuracy. You must ensure all product information is truthful and compliant with applicable laws.
5. Compliance with Laws
You agree to use Aserta in compliance with all applicable laws and regulations, including but not limited to:
- UK Food Labeling Regulations
- California Proposition 65
- FDA labeling requirements (if applicable)
- Consumer Protection from Unfair Trading Regulations
- GDPR and Data Protection Act 2018
- Shopify's Terms of Service
6. Monitoring and Enforcement
6.1 Monitoring
Aserta reserves the right to monitor usage patterns and account activity to detect violations of this Policy. We may use automated tools and human review to identify prohibited conduct.
6.2 Consequences of Violations
If you violate this Acceptable Use Policy, Aserta may take any of the following actions:
- Warning: First-time minor violations may result in a warning email
- Suspension: Repeated or serious violations may result in temporary suspension of your account
- Termination: Severe or repeated violations may result in permanent termination of your account without refund
- Legal Action: Aserta may pursue legal action for serious violations, including hacking, fraud, or IP infringement
- Law Enforcement: Aserta may report violations to law enforcement authorities when appropriate
6.3 Appeal Process
If your account is suspended or terminated, you may appeal the decision by contacting support@getaserta.com within 30 days. Provide details about your case, and we will review your appeal in good faith.
⚠️ Important: Aserta's decision to suspend or terminate your account is final and at our sole discretion. We are not obligated to provide refunds for suspended or terminated accounts.
7. Responsible Disclosure of Security Vulnerabilities
If you discover a security vulnerability in Aserta, we encourage responsible disclosure. Please email us at security@getaserta.com with:
- A detailed description of the vulnerability
- Steps to reproduce the vulnerability
- Potential impact on users
- Your contact information
Do NOT publicly disclose the vulnerability or attempt to exploit it. We appreciate responsible disclosure and will work with you to resolve the issue. Depending on the severity, we may offer a reward.
8. Third-Party Content and Shopify
Aserta integrates with Shopify's API. You agree to comply with Shopify's Terms of Service and Acceptable Use Policy. Violations of Shopify's policies may result in suspension of both your Shopify store and Aserta account.
9. Changes to This Policy
Aserta may update this Acceptable Use Policy from time to time. Material changes will be communicated to you via email at least 30 days before taking effect. Continued use of Aserta constitutes acceptance of updated terms.

11. Entire Agreement
This Acceptable Use Policy, together with the Terms of Service and Privacy Policy, constitutes the entire agreement regarding acceptable use of Aserta. If any provision is found to be unenforceable, the remaining provisions shall remain in effect.
